Marshalands directors judicial review application rejected
By GRACE CHAILE and CHINTU MALAMBO The Lusaka High Court has thrown out an application for Judicial Review to stay proceedings in a matter where Marshlands Consortium Limited directors have been charged with forgery and uttering false documents. Lusaka High Court Judge Yvonne Chembe  dismissed the application on grounds that the applicants have not followed procedures. The applicants in this matter are Tobias Milambo, Nachi Musonda and Richard Lubemba. This is in a case where Milambo 48, Musonda 33 and Lubemba 31 who are the directors of Marshlands Consortium Limited are facing 15 counts of forgery, obtaining money by false pretenses and uttering false documents. It is alleged that the accused forged documents purporting to show that they had been appointed as directors at Ultimate Insurance Company Limited whilst not. It is also alleged that between January 1, 2018 and December 31, 2019, the trio, forged a  Valuation Report or stand 9192/35  situated along Manunga Road, Ndola. The trio, all insurers, allegedly forged the document by purporting to show that it was genuinely issued and signed by authorized  Bitrust Real Estate Innovation Solution for Investors, whilst in fact not. According to court records the trio has severally been making  stints  to stay their matter, before the High Courts in Lusaka, Ndola and Livingstone. The court has however, ruled that the application for Judicial Review must be accompanied by an affidavit. She relied on Order 53, rule 5 of the Supreme Court. Judge Chembe  consequently, discharged the Leave for Judicial Review earlier granted to the applicants on June 18 this year.
