Hubby convicted for assaulting wife

Mulenga Musonda writes @sunzambian  The Choma Fast Track Court for Gender Based Violence has committed a 30 years old man to 9 weeks community service following his admission  to assaulting his wife with a neck chain after finding her with another man idling around 01:00 hrs. This was in a matter in which Joseph Kakoma pleaded guilty to one count of Assault Occasioning Actual Bodily Harm contrary to the Laws of Zambia. Particulars of the offence are that Kakoma on November 20, 2020 in Choma assaulted Mbaita Phiri thereby occasioning her actual bodily harm. When he appeared for plea before Principal Resident Magistrate Idah Mupemo, Kakoma admitted the charge without wasting the Court’s time. In admitting the charge Kakoma stated that he felt jealousy and angry after finding his wife whom he loves with another man around 01:00 hrs. “I hit her with my neck chain, I felt very jealousy” kakoma said. But according to the Facts stated by Senior Public Prosecutor Alex Syulikwa, the accused person pounced on his wife after he found her in the company of her female cousin and her boyfriend standing in the street around 01:00 hrs. Kakoma was later reported to Shampande Police Post where Detective Inspector Kenneth Mwangala investigated the matter which he admitted before being formally charged and arrested for the subject offence. In passing the sentence, Magistrate Mupemo who was impressed by Kakoma’s honesty advised him not to resort to violence whenever he has misunderstandings with his wife. She committed him to 9 weeks community service and to compensate his wife K200 for the expenses incurred or in default to face 9 months imprisonment with hard labour.
