Uncle Convicted for defiling niece
MULENGA MUSONDA writes@SunzambianA 21-YEAR-OLD man is likely to toil for not less than 15 years and if unlucky his entire life in the event the High Court upholds his conviction for defiling his niece and bribing her with a phone to keep quiet. In this matter Brian Kachika was found guilty of having unlawful carnal knowledge of his niece by Resident Magistrate Ethel Phiri.Particulars of the offence are that Kachika on July 8, 2020 in Choma had unlawful carnal knowledge of a girl below the age of sixteen. When he appeared for judgement before the Choma Fast Track Court for Gender Based Violence ,Magistrate Phiri in her findings established that the evidence of the witnesses was corroborating with the offence.According to facts on record, Kachika pulled the 14 year old girl into the Bush and forced himself on her after he ripped off her underwear. He later gave her his phone so she could not reveal what had happened on that evening of July 8.Magistrate Phiri thus found Katicha guilty of Defilement and explained to him through the Court Interpreter Luckson Sibalwa in Tonga, that she had no jurisdiction to pass sentence as the offence carries a minimum of 15 years imprisonment with hard labour and a maximum of Life. She committed Katicha for sentencing to the High Court at its next sitting.Katicha was remanded in custody as he waits arraignment to the High Court The Sun
