MAN GETS 3 MONTHS JAIL FOR ASSAULTING WIFE’S LOVER
MULENGA MUSONDA writes As if the pain of knowing that his wife was having an extra marital affair is not enough, a 26 years old man of Choma will spend 3 months in jail for beating up the suspected lover. In this matter Weld Milimo, 29, a farmer and Nchimunya Mweembastood charged with Assault contrary to the Laws of Zambia. Particulars of the offence are that the two jointly and whilst acting together Assaulted Stayfree Micheelo and thereby occasioning him actual bodily harm. The beating happened on May 15, 2020 in Chomadistrict of Southern Province. This followed accusations that Micheelo was having an affair with Mweemba’s wife. When the two appeared for plea before Senior Resident Magistrate Idah Mupemo in the Choma Subordinates Courts, they both admitted the charge levelled against them. Court: A1 have you understood the charge against you? Milimo: Yes Court: Do you admit or deny? Milimo: I admit Court: Did you assault Stayfree Micheelo? Milimo: Yes Court: Did you have lawful authority? Milimo: No Court: Why did you assault him? Milimo: He was found with my friendís wife. Court: Did he sustain injuries? Milimo: Yes. Court: A2 did you assault Stayfree Micheelo? Mweemba: Yes Court: Did you have lawful authority? Mweemba: No Court: Why did you beat him? Mweemba: He was being undisciplined. Court: I record pleas of guilty. According to Facts stated by Public Prosecutor Pearson Chilumbu, the complainant was roughed up in front of his wife after being accused of having an affair with Mweemba’s spouse. He said the complainant was only rescued by passer-bys and managed to report the matter to the Police. After convicting the two, Magistrate Mupemo advised them not to resort to violence when they’re faced with such challenges. She thus sentenced the two to 3 months in jail with hard labour with effect from date of sentencing. She further ordered that the complainant be compensated with K150 from each one of them. The Sun
