By GRACE CHAILE-LESOETSAA LUSAKA widower has sued lawyer Kelvin Fube Bwalya in the Lusaka High Court seeking a declaration that he is a beneficiary entitled to a portion of his wife’s estate.Ms Robbie Mulenga sued Mr Bwalya also known as KBF in his capacity as the executor of the estate of late Priscilla Chilombo Musole.Mr Mulenga had been married to Ms Musole since 2010 until she died on February 13, 2019.In an affidavit in support of originating summons filed in the Lusaka High Court on December 4, Mr Mulenga is seeking a court’s declaration that his wife died partially intestate which portion of intestacy includes terminal benefits and pensions.He is seeking a declaration that he is a beneficiary entitled to the portion of the estate of Ms Musole that is partially intestate which portion of intestacy includes terminal benefits and pensions.Mr Mulenga also wants the Court to order that Mr Bwalya distributes to him the portion of the estate of Ms Musole that is distributable under the partial intestacy and any other relief the court may deem fit.He stated that his wife had executed a Will where she directed on how her assets must be administered and distributed .Mr Mulenga stated that under the same Will , Mr Bwalya was appointed as the executor of the estate of the deceased.He stated that upon perusal of the Will, he discovered that among the assets to be distributed the pension benefits were not included . He stated that he had been advised by his advocates and believed that since he was the surviving spouse, he was one of the beneficiaries of the pension benefits.
