THE Choma Magistrates Court has slapped a Zimbabwean national who was seeking medical attention in Zambia, 6 months imprisonment for unlawful stay in the Country.
Farai Mutimoyo, 50, of Vic Falls Town in Zimbabwe stood charged with one count of unlawful stay in Zambia contrary to the Immigration and Deportations Act of the Laws of Zambia.
Particulars of the offence are that Mutimoyo on 9 July 2020 in Choma, being a Zimbabwean national entered and remained in Zambia without a temporary permit , or valid border pass.
When matter came up for Facts before Resident Magistrate Ethel Phiri, the accused person admitted that he was a second offender.
According to the facts read by Public Prosecutor Dexter Kwalela, the accused was apprehended by Immigration Officers after they received information that a suspected Zimbabwean national was moving freely without documentation.
Officers investigated the matter and identified the suspect who after being interviewed acknowledged that he was a Zimbabwean but had entered the Country illegally.
Court: Have you understood the facts read to you?
Mutimoyo: Yes
Court: Are the facts true and correct?
Mutimoyo: Yes
Court: Do you wish to add or subtract anything from the facts?
Mutimoyo: No, everything is correct.
Court: By your own admission and confirmation of the facts as true and correct, I find you guilty and convict you accordingly.
In passing the 6 months simple imprisonment sentence, magistrate Phiri observed the fact that he was a second offender and remorseful of his action.
The Court also took into consideration that Mutimoyo was in the habit of staying in other Countries without documentation.
Mutimoyo will be deported immediately after serving his sentence by the Department of immigration.
