Haemorrhoid man gets suspended sentence
MULENGA MUSONDA writes THE Choma Magistrates Court has sentenced the man who claimed to have been using Marijuana to treat his Haemorrhoids to 6 months with hard labour. In this matter Nasser Chileyi Mugoba of Batoka area in Choma stood charged with trafficking in Psychotropic Substances contrary to the Laws of Zambia. Particulars of the offence are that Mugoba on 15 April 2020 in Choma trafficked in 65 grams of Marijuana, a herbal product of Cannabis Sativa without lawful authority or medical recommendation. When he appeared for plea before Resident Magistrate Salie Kanunkaearlier, he willingly admitted the charge read to him and explained that he was using the Cannabis to treat his Haemorrhoids as thats what his late father who succumbed to the condition used too. According to facts dictated by Senior Public Prosecutor Charles Chinzai thursday morning, Mugoba was apprehended by Drug Enforcement Commission Officers after they received a tip off from concerned members of the public that a known man was selling the controlled drug to the community. The officers mobilized themselves in the area where the suspect was identified and the purpose of the visit made known to him. Upon searching him, a loose vegetable matter was found in his pocket. A further search on the premises yielded to the recovery of 32 balls within his premises. He was then taken to Choma Central Police Station where he was formally charged and arrested for the subject offence. In mitigation, Mugoba pleaded with the Court for lenience saying he was a sickler and still suffers from Haemorrhoids. Magistrate Kanunka after observing that he was a first offender who readily admitted the charge, she sentenced him to 6 months imprisonment with hard labour but suspended the sentence for 18 months in which he is not to commit a similar offence.
