STEPHEN MWEWA writes @SunZambian A 30-year-old peasant farmer has been sentenced to death for defiling and killing his one-year six-month-old stepdaughter. In this matter Andrew Mwamba of Kanyanta Village in Chief Munkonge’s Chiefdom in Kasama was charged with murder of Mildred Mukuka in January 2018. The Kasama High Court handed down the death sentence. Ndola based High Court Justice, Derrick Mulenga, who is sitting in the Kasama High Court, said the State had proved the case beyond all reasonable doubt and convicted Mwamba accordingly as charged. According to the prosecution evidence, on the material day, between 05:00 and 06:00 hours, Mwamba’s wife, Melody Chansa, woke up to a rude shock as her baby was dead. Ms Chansa had narrated that she found her husband outside in a traditional shelter naked between 05:00 hours and 06:00 hours and that when she asked him as to why he was like that he responded that it was very hot so he wanted to have fresh air. She went back inside the house as she was about to go back to sleep she discovered that her baby was not breathing. A night before, Chansa, her husband and the daughter went to sleep on the same bed around 19:00 hours, but that when she woke up the following day and discovered that her baby was dead with injuries on her private parts. The child also had semen on her private parts while the skull was broken. At this point, Mwamba fled from home and was apprehended from Matipa Village in Luwingu district on 14th February by members of the community who later handed him to police in Kasama. When passing judgement, Mr Justice Mulenga said his hands were tied and that the only verdict he could pass was to sentence Mwamba to death by hanging, until pronounced dead.
