Mulenga Musonda writes The Nakonde Magistrates Court has convicted a 30 years old man for brutally defiling his 14 years old niece. The man  was found guilty of defiling his niece when he appeared for judgement before Magistrate Litungi Litungi. Particulars of the offence are that the farmer unlawfully had carnal knowledge of a girl below the age of 16 on 27th March 2020 in Nakonde. According to the evidence on record, the accused defiled the minor in the bush when she went to collect some relish. The 14 years old juvenile told the Court that the man grabbed her by the waist and took her in the bush where he stripped off her pant and defiled her. She testified that during the painful lurid encounter, the accused threatened to stab her with a knife. This was before he ran away leaving her with a bloody soiled skirt and torn pant. When matter came up for judgement, Magistrate Litungi found the accused guilty after establishing that the victim had no motive to falsely accuse him of the offence. The Court further established that the medical reports were consistent with the allegation. After finding him guilty, the Court informed the man that the Subordinates Court does not have the jurisdiction to pass the sentence but instead his matter will be committed to the High Court in line with the Criminal Procedure Code.
