Mulenga Musonda writes@sunzambianA 33 years old gardener admitted before the Choma Fast Track Court for Gender Based Violence to defiling a girl of 9 years of age.In this matter Foster Vwavwa of Chufwipa Village in Choma is charged with Defilement of a child contrary to the Laws of Zambia.Allegations are Vwavwa on September 21, in Choma had unlawful carnal knowledge of a girl below the age 16.When he appeared for plea before Resident Magistrate Ethel Phiri, the accused person understood the charge and the proviso that he could use in his defense if he assumed the girl was above the age of 16 at the time. After understanding the charge and proviso, Vwavwa pleaded guilty to the offence, but stated that he did not know how old she was when he unlawfully had carnal knowledge of her.Court: Have you understood the charge?Vwavwa: Yes I have understood.Court: How do you plead?Vwavwa: I admit.Court: You admit that you had carnal knowledge of the girl?Vwavwa: Yes.Court: Did you know the girl was below the age of 16?Vwavwa: She didn’t tell me that she was below that age.Court: So you didn’t know?Vwavwa: No.Court: I record a plea of not guilty.After entering a plea of not guilty the matter proceeded into trial where the victim’s mother testified that she noticed blood stains on the stool where her daughter sat, and after interrogating her she disclosed that the Vwavwa had sexually abused her. The girl also testified that Vwavwa found her at the garden and dragged her into the bush where he took off her clothes and got on top of her. But when questioned by the Prosecutors to state exactly what happened when he got on top of her, the girl remained mute until the State applied for an adjournment to engage her for the second time.The matter will come up on November 11 for continued trial.
