COURT ORDERS STATE TO COMPENSATE HORIZON EDUCATION TRUST
By GRACE CHAILE LESOETSA THE Lusaka High Court has passed consent judgement ordering Government to compensate Horizon Education Trust Limited. In this matter, Horizon Education Trust, citing the Attorney General as respondent, sought an order of certiorari to quash the decision by Government to compulsorily acquire stand number KABUL/N_59565/196 in Kabulonga, known as Horizon School. According to a consent judgement passed by Judge Gertrude Chawatama, Government should compensate Horizon Education Trust in respect of all unexhausted improvements (all buildings, structures and/or other fixtures erected by Horizon Education Trust on the land). “The respondent (Attorney General) shall compensate the applicant in respect of all movable properties that the respondent had taken from the applicant and is using at the school,” “In default of agreement on the quantum by the parties, the assessment of the compensation in clause (1) and (2) shall be referred for assessment before the Deputy Registrar,” Judge Chawatama ordered.
