MULENGA MUSONDA writes A 22-YEAR-OLD man who lied that he was a Juvenile aged 18 years was caught pants down by the Choma Magistrate Court after his mother revealed his real age. In this matter, Derrick Munsaka is charged with Criminal Trespass contrary to the Laws of Zambia Particulars of the offence are that Munsaka on 26 January 2020 in Choma entered Samuel Hampongo’s premises with intent to steal, annoy or injure the said Hampongo. When the matter came up for plea following the matter being adjourned  for age determination of the accused by the parents or social welfare department, the accused’s mother who had been summoned told the Court that her son had lied to the Court earlier as he was born in 1998 and not 2002. The mother was summoned because the accused person stated that he was a Juvenile aged 18. And according to the Law a juvenile cannot take plea or stand trial without the representation of his parents or social welfare officer. Magistrate Muyambango Munukayumbwa who was not pleased with the accused persons conduct warned him that what he had done was a serious offence but forgave him. When all was settled Munsaka proceeded to plead guilty. Court: Have you understood the charge read to you? Munsaka: Yes Court: How do you plead? Munsaka: I admit Court: Did you enter the complainant’s yard? Munsaka: Yes Court: What did you go there to do? Munsaka: I went to watch what was happening as they were a lot of people shouting at Mr Hampongo. Court: Were you part of the people shouting at Mr Hampongo? Munsaka: Yes, there was a rumour that he was keeping people in his house after abducting them. Court: I record a plea of guilty. The matter was adjourned to 29 April 2020 for facts and the accused was remanded in custody. The Sun
