Choma Man claims he beat up wife for committing adultery
Mulenga Musonda writes @sunzambian A man accused of assaulting his ex-wife has argued before the Choma Fast Track and User Friendly for GBV that the two fought when he caught her red handed in bed committing adultery with another man. In this matter Nchimunya Lumang’ombe 34 of Namwala district is accused of Assault Occasioning Actual Bodily Harm contrary to the Laws of Zambia. Allegations are that on December 20, 2020 in Choma, Lumang’ombe assaulted Koviness Silucha and thereby occasioning her actual bodily harm. When he appeared for plea before Magistrate Muyambango Munukayumbwa, the accused person admitted to beating up his wife before he later changed his plea to not guilty after Counsel Ernest Chilufya applied to represent him following a twist in the Facts read by the state. Court: Have you understood the charge? Lumang’ombe: Yes Court: Did you beat up the complainant? Lumang’ombe: She is my wife, yes I beat her. Court: What did you use? Lumang’ombe: I slapped her on the back of her neck Court: Did she allow you? Lumang’ombe: No Court: Why did you slap her? Lumang’ombe: I caught her in bed red handed committing adultery with another man. Court : I record a plea of guilty. According to the facts read by Public Prosecutor Dexter Kwalela before the Defense Counsel intervened, Lumang’ombe is divorced with his wife; he charged at her whilst she was in the field for no apparent reason. Counsel Chilufya after applying to represent the accused applied that he retakes plea to which he pleaded not guilty. He was granted K2, 000 bail in his own recognisance and to provide two suitable sureties. The matter will come up on January 21 for commencement of trial.
