5 family members’ assault case adjourned again

RABECCA BANDA writes DEFENCE in matter where five persons allegedly assaulted a man has failed to continue for the second time. This is in a case where Izukanji Simbule, 24, a student, Cliff  Simbule50 a businessman, Sylvia Simbule 44 a secretary, Mapalo Simbule 19, a student and Wiza Simbule 21 a student allegedly assaulted ChrisantiusChangwereza 34, of Makeni thereby causing him occasioning actual bodily harm on December 24 2019. This was when the matter came up for defence at the Lusaka magistrates court before magistrate Jennipher Bwalya. Aggripa Malando a lawyer from legal aid board said a  colleague who was representing all five accused persons was transferred and he has since taken up the matter. He said he will represent all five accused persons but was not ready to proceed with defence because he needs to update himself with the courts record and get instructions from  Izukanji and Wiza who were absent. Mr.Malando informed the court that Izukanji and Wiza were absent because they are  quarantined having been in contact with a relative suspected to have Covid-19. Mr. Malando applied for the matter to be adjourned. Public prosecutor Mr. Museta said it was the second time the defence was applying for an adjournment. He said he had no objection to the application made by the defence counsel. Magistrate Bwalya warned that it is the second time the defence is applying for an adjournment.
